By using the web-application lavilo.com (the “Application”), you (the “User”) agree upon the Terms of Use set forth below.

Lavilo is a registered trademark of Lavilo LLC, North Carolina, (the “Company”).

Notwithstanding any limitations by the 3rd-party hosting company, the Application, its design, all texts, graphics, images, content and custom programming as well as the registered trademark “Lavilo”, the favicon and the logo are the property of the Company.

The Company grants the Users of its Application a non-exclusive, non-transferable, non-sublicensable, terminable license to access and use the Application for the User's personal use. The User agrees to not access, reproduce, duplicate, copy, sell, re-sell, modify, distribute, transmit, or otherwise exploit the Application or any of its content for any purpose, except for the User's personal use, without the express written permission of the Company.

Every effort has been made to ensure accuracy of the information presented in the Application, (the "Traveltips"). However, the Company assumes no responsibility for its accuracy and the information should not be relied upon as accurate, timely or fit for any particular purpose. Further, the Company does not assume an obligation to update the information contained in its Application or to advise of any further developments concerning any topics mentioned. Traveltips or any information in the Application may be changed at any time without notice.

Furthermore, Traveltips are not intended to encourage a User, explicitly or implicitly, to visit any mentioned location or to engage in any activity, including but not limited to a visit of a restaurant, bar, park, museum, theater or music venue, (the "Activity"). Should a User decide to visit such location or to engage in an Activity, it is solely based on the User's own discretion and at the User's own responsibility. Notwithstanding any other provision herein, the User also agrees not to operate a vehicle, machinery or alike while accessing the Application, nor to put the User and others in harm’s way while the User accesses the Application.

A User should always use his or her own judgment about the suitability of any Activity, such as of any outdoor sports activity, of the difficulty of hiking and biking trails, of the dietary appropriateness of any food item or the use of alcohol.

It is the sole discretion of the Company to list a Traveltip in its Application. The Company exercises complete editorial control over and assumes complete editorial responsibility for any Traveltip in its Application, except for any link to other web sites outside of the Application, ("External Links").

External Links in the Application are provided for the User's reference and convenience only. The Company does not assume responsibility for the accuracy, appropriateness or views expressed on web sites reached through an External Link, ("External Web Site"). The Company is not acting as a publisher of any materials contained on External Web Sites, nor does the Company seek to control the content of or maintain any type of editorial control over any External Web Site. Links to External Web Sites should not be construed to imply that the Company is in any way affiliated or associated with, or is legally authorized to use any trade mark, trade name, logo or copyrighted symbol found in the External Link or description of the External Link to External Web Sites.

Although the Company may use standard and typical web-analytics services from third parties, such as but not limited to Google, Microsoft and/or Squarespace, to improve its Application, the Company will not store, sell for a fee or otherwise transfer any such information to any third party. The Company, however, may use such information to direct its own sales efforts to market its Application and services to prospective customers.

The Company may modify, update, suspend or discontinue the Application, in whole or in part, at the Company's sole discretion for any or no reason, at any time and with or without notice. The Company shall not be liable to any User or other third party for any such modification, update, suspension or discontinuance.

The Company may, in its sole discretion, modify these Terms of Use at any time effective upon posting the modified Terms of Use in its Application without notice.

The User is responsible for regularly reviewing information posted in the Application to obtain timely notice of such changes, and if the User does not agree to the amended terms, the User agrees to immediately stop using the Application. YOUR CONTINUED USE OF THE APPLICATION AFTER SUCH POSTING MEANS THAT YOU ACCEPT AND AGREE TO BE BOUND BY THE MODIFIED TERMS OF USE.
